Overview
Mr. Cunniff joined Howrey in 1990. He has represented clients in
litigation in state and federal courts, as well as before
federal regulatory agencies nationwide, both on the trial and
appellate level. He has also been involved in arbitration. His
practice involves complex litigation involving breach of
contract, antitrust, business torts, fraud, intellectual
property, and other commercial issues.

Highlights
COMSAT Corp. v. News Corp., Ltd, CV-96-7528 (C.D. Cal.).
Represented plaintiff COMSAT in breach of tariff and tortious
interference actions related to satellite telecommunications
service for direct-to-home broadcasting venture in Latin
America.
Alpha Lyracom Space Communications, Inc. v. Comsat Corp.,
113 F.3d 372, 1997 U.S. App. LEXIS 11356 (2d Cir. 1997).
Represented defendant COMSAT in antitrust action brought by
PanAmSat satellite system involving worldwide market for
satellite telecommunications. Case dismissed on summary judgment
and affirmed by Second Circuit.
Sea-Fone, Ltd. v. Communications Satellite Corp., 117
F.3d 1414, 1997 U.S. App. LEXIS 24020 (4th Cir. 1997).
Represented defendant COMSAT in action involving claims for
breach of contract, fraud, trade secrets, antitrust and RICO.
Case involved provision of satellite telephone service to
sailors aboard U.S. Naval vessels. Dismissed on summary judgment
and affirmed by Fourth Circuit.
Techplan Corp., ASBCA Nos. 41470, 45387, & 45388, 96-2
B.C.A. (CCH) 28,426, 1996 ASBCA LEXIS 141 (July 2, 1996). Lead
trial counsel for TechPlan in successful bench trial before
Armed Services Board of Contract Appeals. Case involved
determining levels of reasonableness for including executive
compensation in government contracts. It was considered to be
leading case on this issue, and several government contract
publications have published articles on it.
Cable & Wireless USA, Inc. v. MCI WorldCom, Inc., Civ.
No. 99-204 (D. Del. 1999). Representing Cable & Wireless in
breach of contract action relating to the sale of MCI's Internet
business to Cable & Wireless.

Pro Bono Experience
Community for Creative Non-Violence v. Unknown Agents of the
United States Marshals Service, 797 F.Supp. 7 (D.D.C. 1992)
Represented the Community for Creative Non-Violence (CCNV), an
operator of a homeless shelter, as well as a class of homeless
persons against defendant, the United States Marshals Service.
The case involved a pre-dawn raid by the Marshals Service at the
CCNV shelter in January 1992. After a three day bench trial, the
court found in favor of plaintiffs holding that the Marshals
Service violated the Fourth Amendment rights of plaintiffs and
enjoined the Marshals Service from conducting warrantless
searches at the shelter. The published decision was one of the
first on the issue of Fourth Amendment rights of homeless
persons.
Washington Legal Clinic for the Homeless v. Marion S. Barry,
Jr., 107 F.3d 32 (D.C. Cir. 1997) Represented a legal
services provider for the homeless and a class of homeless
families against the District of Columbia in a case involving
the city's shelter program for homeless families. The District
of Columbia had restricted the access to its office waiting
rooms by lawyers for plaintiff Washington Legal Clinic for the
Homeless (WLCH). This policy was successfully challenged on
First Amendment grounds. The district court ruled on summary
judgment that the District's policy violated the First
Amendment. A trial was held on other issues, including whether
the plaintiffs' due process rights had been violated by the
District of Columbia's allocation and appeal procedures
regarding homeless shelter. After a bench trial, the district
court ruled in favor of plaintiffs. The D.C. Circuit reversed
this ruling but by the time it ruled, most of the reforms urged
by plaintiffs had been adopted by the District and were left in
place after the D.C. Circuit's ruling.
